We have an office "bully" that continuously causes problems, harasses people (not sexually), refuses to do his job and gets away with with it, and has caused several people in our office significant amounts of stress. He has been reported to management over and over again about several different issues but nothing ever gets done about it. What are my rights as far as refusing to go to work and subject myself to that type of environment? I am mentally and emotionally stable but going to work and dealing with this situation is having a negative effect on my emotional well-being as well as my life outside of work. Do I have any options at all or am I just stuck?

Go to a doctor and get someone to state that this person is causing undue stress. Then you take it to your HR and have them see that either the bully has to go or they are going to be paying you to remain at home unable to work in the environment, and costing them more money in the long run.

How has it been reported to management? I'm not saying that the reports are in the wrong, but going in and saying "so and so" is causing me stress isn't going to get anything done. Write down exact dates, times, and actions/words. Document every issue that is created by the person, and the date and time it was committed. Keeping this log for a week will do wonders. Then take the log to your supervisor(s), and discuss the incidents, and what is going on. Inform them that this person doesn't perform, and isn't doing anything but causing undue stress, and is costing the company good staff because they quit due to them. Having facts (not that you haven't before) will allow the management to take actual action. You can't fire someone due to "causing stress". But if they have the instances documented as to what this person isn't doing in the way of their job, then they can do something. Believe me when I say that the log will get things done very quickly. If it doesn't, keep going up the ladder until it does. And document the dates and times you reported the incidents to, and the names of the ones you reported them to. Documentation is a pain in the butt, but it will save your butt over and over again.

touchy subject! how big is the company? smaller ones are harder to deal with. If it's a larger company make your complaint directly to the human resources department and explain what's been going on and the fact that you've complained a number of times. Ask what more you can do to rectify this problem.

Also try to talk to a lawyer (unless one answers here). DO take it further; don't take their inaction as your last option; Don't just stop going to work!

Unfortunately if it's a smaller company you may be out of luck, but push as far as you can. If you're still miserable, it is time to look for a new job.

If you can convince a Doctor to sign a report about your mental and emotional distress you may be able to file a claim with Worker's Compensation. This would get their attention.

If you can get a Dr saying that this is causing you harm then yes you can sue him! If management is not doing there job, then I would go to the labour Bord.

What kind of company do you work for? I work in a company that won't tolerate ANY kind of that crap. Can't you go to Human Resources - get a few of you together and sign a petition and send it in.
