In basic terms an insurance company has refused to pay out on a policy that should be triggered on health grounds citing that they believe that all avenues of treatment have not been explored according to their expert. My G.P. and specialist dispute this. The insurance company are refusing to pay and so I want to investigate legal proceedings on a no win no fee or legally assisted basis and would very much like to know: which type of lawyer one should approach and second, would anyone recommend a lawyer practicing in this field in the Sunderland and Newcastle locality? Personal injury attorneys deal with insurance companies all the time; a good contracts attorney would be useful, too. Either speciality could assist you.

Your first action shuld be to go through the complaints procedure of the insurance company. Start off by saying that you think that they are not 'treating you fairly 'in this manner. They have to acknowledge your letter in a week and give a reply in 4 weeks and a final reply in 8 weeks - you may then have the right to take it to the FOS - it consts you nothing the insurer has to pay for the referral and are bound by the results.

you need to contact an attorney to see what is the best way to resolve this dispute with the insurance company. Insurance companies try to get buy with giving as little as possible b/c ppl dont hire an attorney to fight for their rights. GOOD LUCK.

First of all please check up whether there is Insurance Regulatory Authority in your area to whom you can refer insurance related complaints.If it is not there any advocate can file a civil case against the insurance company.
