I am a contracted employee always have been, I am pregnant with twins. My employer does not pay in to unemployment for me, does this mean I wont get umemployment disability when i am forced to take maternity leave?

Ok my employer does not have any medical, insurance or anything and he doesnt pay into the system.. they are calling me self-employed, but I am not self employed.. Im confused- how can I get short term disability by myself?

This is not good. Your employer is most likely breaking state and federal laws. There is a legal criteria an employer has to meet in order to qualify as a nonemployer with contracted employees. First Your employer cannot set a time when your are required to be at work. If you have a set time everyday then this employer is in big trouble. Contracted employees have the freedom to work and perform the duties that best fits their business. As long as the work gets done in the time frame aloted the employer cannot set a specific time of day to do the work and require you to be in there office. I would check with the state your are in to verify whether you are a contracted or regular nonexempt employee. If you are nonexempt he has to pay your unemployment and depending on the laws in your state offer you insurance. Good Luck

When you go on maternity leave, you do not use unemployment/disability. Do you have a short-term disability plan through your employer? That it what paid for my maternity leave. Each policy is different. Mine paid nothing for the first two weeks AFTER delivery; after that it paid 60% of my salary. Again, policies differ by company so you will have to check.

You need to be paying into state disability in order to receive it.
* I am a sub-contractor and am considered to be self-employed too. You would have to be paying for your own disability insurance, and I looked into it and it was better for to just save the money up myself. Plus when going through the private insurance agencices, there is a 30 day waiting period to get the insurance, so it really wouldn't be worth it.

You don't receive unemployment benefits when you're on maternity leave. You are still employed. If you have short term disability through your insurance company, they will pay you benefits.

My friend found out she was pregnant and she worked in a nursing home. Under doctors orders she could not lift over 25 lbs. She was forced to be "medical leave" by her boss. Who in return did not give her any money at all and was forced to go onto unemployment.

You wont get unemployment anyway at least if you are in the US. By defination unemployment is only offered if the person is ready and able to work on that given day.

that is exactly what it means. I am in the same situation. I can accrue vacation, sick and personal time and use that though.
