Ok so I'm an asthma patient i have asthma.I get home today and in the mail is a big manila envelope.In it is another envelope from kaiser(the hospital).The letter says that they tried to send me some of my personal medical information but it was sent to the wrong member.In my med class my teacher told us that something like this is considered a violation of a patients privacy.And by federal law I heard I could sue.Is it true can I sue Kaiser?

my information was sent under another kaiser members name.

the information that was sent to the other members contained info in which they could use to get drugs I'm presribed.

I just looekd at the date on this paper I was suppose to recieve this 6 months ago and I'm only hearing about this now.

Sure, go ahead and sue.. I'm sure you could receive 2 or 3 dollars. In fact if you are so desperate to sue for this, maybe I'll just send you the 3 dollars.

You're the typical fat American trying to sue everybody and everything for inconveniences trumped up to injustices. Shut the f*ck up and deal with the fact that it was a mistake, possibly because YOU, (yes, you!) didn't update your address with them. A "violation of patient privacy" would be if the police or your neighbor asked them info about your medical history and they gave it to them.

Most places you have to show actual damages, not imaginary ones based on your desire for money. So until someone actually does something with your records, you're still broke and looking to mooch off somebody else.

Sure. Sue them and anyone else in life that you come across who makes an honest mistake. Our society isn't nearly litigious enough.

Sure you can sue. Anyone can try to sue someone else for damned near anything. However, your case will fall flat on its **** unless you can demonstrate DAMAGE from their error.

Just how WERE you damaged ?
