Yes this is domestic violence and he should be charged as such. No person has a right to lay a hand on another person.

Yes, even if in a consensual relationship where the wife agrees to be spanked by her husband for transgressions, some states, including Florida, will still consider it domestic violence. However, this is not the case if it's the man that is being spanked by the wife, if that's relevant to your question.
Now, if the spankings were not consensually agreed to, then no state would disagree that the spankings would be domestic abuse. Even the spanking community will agree that a domestic discipline relationship should be consensual for all parties, though I have seen some sites that claim that a husband has a God-given right to discipline his wife. These are mostly wackos, though, and I'm atheist, anyway. :P
That being said, a consensual disciplinary relationship can be as healthy as any vanilla relationship, and perhaps more so. How many people can truly say that they always do EXACTLY what they should, without being pushed. Have you ever stayed up too late on the internet, even though you KNOW you have to get up early? Have you ever tried to quit smoking, only to give up because you don't have "the willpower" for it? Ever wonder if you'd do better with these things if someone was reminding you that there are repercussions for actions?

It depends of the source. If you spanking a woman for pleasure or because the most stupidest thing, that's a domestic violence, but if she done something unforgivable or bad is not, is discipline.

yeah if its comfortable and exciting or she asks for it vocally. its exciting yet not all women individuals like it and that i don't think of its "christian" the two, there's a christian kinfolk self-discipline internet site yet they are extremely cult like. IF the two women individuals agree then it could help relieve tension and make your marriage extra exciting and you do discover you admire one yet another too even so I delight in it lolz. I am a dispatcher and have had this conversation with police officers. The way I understand it is...If both parties agree and it is 100% consensual, it is NOT domestic violence. To keep yourself safe, it is best to have on record a signed "discipline contract" that both the husband and wife have agreed to and signed. This will help keep you out of trouble.

Sandstorm, you're great! I am a fan. You really are too much...... If a man were to discipline his wife by spanking her it wouldn't be considered domestic violence, it would probably be the worst beating of his life! 1. for assuming he could 'spank' her and 2. for actually trying to do it.

We aren't living in the middle ages. It would absolutely be considered domestic violence. A wife is not an object or a naughty child. It is not a husband's job to discipline a wife.

If the spanking is meant as a form of discipline and against one person's will, yes that is a form of abuse. If it is a mutually agreed form of foreplay, no it's not abuse.
