A friend and I were in a store the other day. He wanted to purchase a tin of chewing tobacco. He has an expired license but he does have a valid social security card. He showed the cashier both forms of ID and was denied. She would not sell him the tobacco. He says that it is illegal for the store to not sell him the tobacco. Is this true?

It is not illegal. Some stores have right to refuse sale. On top of that, expired license is not valid, either as primary or secondary ID.

Yes. There were a couple of times where I could not use my US Passport to buy alcohol. Do not ask me why but I know they are allowed to do it. One of the conditions about purchasing tobacco and alcohol products is the purchaser must have valid picture identification to purchase it. Also it is the discreation of the store owner to decide what is and isn't valid to them. I used to live in a college town in NYS and most convience stores would only allow a person to use a New York state drivers licsence to buy these things, because they felt that it was easier to decipher what a fake drivers licsence is and what isn't. Also an expired drivers liscence is not a valid form of ID.

Neither is a valid form of ID. An expired license isn't worth the plastic it's preserved in.

Even if the license was expired or not, they could refuse selling you tobacco. If the owner has any doubts, like a possible fake ID, etc... they could refuse selling it to you.

It is not illegal for any store to sell you anything, so long as they have a gender-neutral and race-neutral reason for it. It's their store. They don't really have to sell to anyone they don't want to. When it comes to something like tobacco that could get them in big trouble if they sold it to the wrong person, it is a "better safe than sorry" situation. Sorry, dude.

Yeah if the license is expired, it's absolutely worthless. Soc security cards don't say your age so yeah.
