thats not what deposites are for, and doubt if a judge would allow it........

The landlord can choose to use the security deposit to pay for past-due rent. However, if you're been evicted for non-payment, he can oust you after three days with notice.

It does take a while to physically remove you from the premises, but it's not pleasant and involves the authorities.

You can't ask the judge for that. I lived in apartments for about 15 years and I never, ever got a security deposit back, even though I was never evicted, never left under bad terms, and never did damage. They will just always find a way to keep it, even under the best of terms. The landlord is going to tell the judge he needs to hold the security deposit until after you're out, to check for damage and wear & tear. And trust me, he'll find some..

No, the deposit can not be used for rent. After your landlord gets his property back you have 72 hours before the sheriff arrives.
