But he was arrested.he was arrested for assault after pushing me and throwing me down steps and dragging me through the house.I broke my toe and have herniated disc.He is saying I was hitting him.Can that actually hold up in court???I didnt touch him except when he was dragging me,I tried to go for his private area but not successful.I have pictures of my body being black and blue that the police took and was at the hospital right after.His sister in law said she heard him saying repeatively, leave my house and stop it.He did say stop it because I was hysterical crying.

You have physical proof of your injuries. I'm willing to bet he does not...even if he did, it's self-defense.
Don't worry too much. I have no doubt the judge will see the truth.

It could hold up in court... if not for all the rest of this picture. Even if you did hit him, how does he justify breaking your toe, beating you black and blue, and busting up your back? That said, if you really hit him, HE'D have some marks on him. A bruise. A scratch. SOMETHING. It does not take a prosecutor or policeman to see what is wrong with that scenario.
Your chances of successfully winning this case are very good, especially if he is bigger than you. There are never any guarantees, because people on a jury can be idiots, but when they see the pictures and see how badly you were hurt in relation to your supposed and unproven hitting of him, it does not look good for the ex. Plus, it is such a common lie by abusers that your prosecutor should know exactly what to say to deal with that argument.
It is his word versus yours in regards to your hitting him, but it is a FACT backed up by EVIDENCE that he beat the crud out of you. If there is any justice, it will be a slam dunk case and you'll win. Good luck!

Unless he can prove you hit him it'll be a he-said-she-said. You have pictures showing your bruises, right? And you had him arrested and filed a police report, right? If that's the case, you have plenty of proof that he hit you. The only way he could prove you hit him is if he reported it to the police when he was arrested and had pictures taken. So if he just gets up there and says "Well, I hit her because she hit me" without any proof to back that up, you say "He's lying -- I NEVER hit him." Judges don't care about what you know; they only care about what you can prove.

It's unethical what your ex boyfriend has done to you and you seem to have the proof. But what were you doing at his house, is what the judge might be wondering??? The judge might wonder if you were the instigator of the fight?? Because you were hurt badly and he wasn't doesn't give him the right to treat you in that manner.

Everything should go your way since you have all the pictures and whatnot, and he was not bruised at all. All the evidence shows you were the one being abused, and not the other way around.
