OK- I read some of the replies to your question and it seems you need HELP! Got a solution I think you'll like. No help from police? Stole your ladder? Hmm. I think you should visit your local tractor/farm supply store. Here's what you need - The materials and Unit to install electric fencing! You will need enough white ceramic wire holders that you will nail (with special nails) to the top post of your existing fencing. Enough wire to surround the fenced in area plus enough to attach to the "unit" or electric box. The salesperson will help you with all this. You should be able to install this in a few short hours, less with help. the next time your neighbor tries to scale your fence he'll be in for the shock of his life! Literally! It won't "Kill" him, but it will give him a nice JOLT! I have had horses most of my life and I can tell you from experience it will make your teeth rattle! The salesperson will help you with voltage. You just need what would keep a horse or cow in a pasture! And a fat a** neighbor out! :D Hope it helps! PS: you can turn it off & on when you want. Oh, and if you touch it when you're wet? Well...the memory is vivid!

Put a no trespassing sign up on your fence, then take a picture of the no trespassing sign up. Next time you see him or his friends having wandered over into your pool take a picture of them in your pool, then call the police. If you have a no trespassing sign up, you can have them arrested for trespassing on private property. If the police department still gives you havoc, take the pictures of the no trespassing sign and the pictures of them in your pool to the police. The police should have to do something if you have irrefutable evidence such as that.

And while you're at it, if he stole the ladder also have him charged for stolen property. Like the one person said, don't state that it is your neighbor, just state that it is someone trespassing on your property. You should be able to charge both him and his friends if they trespass and you have pictures of it.

And if the police don't do anything after the pictures, I'd recommend getting a restraining order. Normally a restraining order means that the person has to stay x number of feet away from you at all times. Since the person is your neighbor that might be difficult. I'd only use the restraining order unless absolutely necessary.

I find it hard to believe that the police wont do anything, especially since your neighbour is entering your yard over your fence. My response would be to cover your pool with a rollout pool cover while you are away from home, and lock it using a padlock.
The next time you find your neighbour in your backyard, call the police immediately. Do not mention that you know who it is, simply say that there is someone trespassing in your yard/pool at that moment, and that you would like a police car to be sent out to help remove the person from your property. Alerting the police in this manner will get their attention, and it will help deter them from assuming its a neighbourly dispute.
Goodluck!

Have him arrested for theft and trespassing. Put up a video camera that shows he is sneaking onto your property so you have actual proof and not just your word. Have someone housesit and take pictures of what he is doing. That way you also have someone else to verify your story. Also file a restraining order to keep away from you, your property and that way if something happens you have something filed. Remember too that if he or his friends get hurt he could sue you if you do not have something in place.

Put up No Trespassing signs that can be seen above the fence and string some barbed wire on your side of the fence. Then if you see him in your yard, call the police.
