No you don't need a lawyer. You need to contact the department of labor in your state. They will have a group called wage and workplace standards or something similar that will contact your employer about your last 3 checks.

You can only sue after you exhaust all of your administrative remedies (i.e. using the department of labor). So, contact the labor department.. they will get the job done for you and it wont cost you anything!

No you don't. At least not until you can express your problem better.

a) If you are claiming a violation because of the termination, then you will need to be able to express how you were discriminated on or injured.

b) If your complaint is the two weeks since your paycheck was due, you should call the former employer and get a fixed date when it is going to be paid. If they do not provide the check or a due date, then every state has a labor commissioner's office (it may have a different title in your state) that will follow up on your complaint and generally get your money for you at no charge. Check your state office directory to find out who and what is necessary.

easy eh?

A lawyer may cost you more money than your 3 final checks, but it will definitely cost the company a lot more. You should contact the company first, and tell them that if you did not receive the 3 final checks in X number of days, then you will be forced to take legal action against the company. The company will usually settle with you because they know that going to court will cost them more money.

But sometime, it does not hurt to ask first. Call the company first, tell them the situation and ask them nicely. If nothing works out, then sue!

Good Luck!

Chances are, a lawyer will cost more than your 3 final checks are worth.
