No, don't do that because if he has a copy of said picture and can prove that you tampered with it then you will be the one in trouble. Nothing will reflect more poorly than a woman who is willing to lie to the court to get her way, it can end up that you lose custody. So unless he was abusive to you or the children do not cut him out of their lives no matter how bitter you feel towards him. It will bite you in the a$s when they grow up.
I speak from experience, my mom pulled that crap and kept my dad away from me. Let's just say I was a little pissed. It bit her big time. This is no longer about you and him, it is about what is best for the children. They should be put first, your feelings do not enter into it.

I doubt if a court will even take into Evidence an Altered Picture. Also you say this was a Haloween Party. Lots of people dress as the opposite sex when they go to them! I don't think that cross dressing is a crime in this country anyways. I doubt that it would be used to describe someone as an "Unfit Parent". Get real evidence! If thats all you have, then you have nothing. Don't make things up!

Where are your children in all this? He is still their dad, no matter what kind of pond scum you think he is. It will be much better for you and your children if you just stick to facts and not try to manipulate the system to try to prove he is unfit. Actually, that may backfire on you, big time.
If you know of particular things that would show he is unfit, your testimony and that of any witnesses would help. But if this is just your anger (no matter how well it's justified), your children become the real victims.
No matter what has happened, may I suggest that you never let your children hear you say an unkind thing about their dad? After all, they are a part of him and if you are this angry and out of control, how do you think they will feel about you? I'm not saying you are, I'm saying how will your children interpret your actions??
Please try to put your children first in all this. I understand you are angry and perhaps justified in this, but letting your emotions control helps no one.

You can use the photo for custody matters. And I can tell you how it will turn out after 35 years in Family Law practice.
YOU: Your honor, I have a photo of my husband in women's dress.
JUDGE: And what is the purpose of sumitting such a photo?
YOU: To show the moral fiber of the defendent and his ability to parent his child.
JUDGE: And of what relevance is this photo to that issue?
YOU: I don't think it's appropriate for a man who dresses as a woman to have custody.
JUDGE: And when did it matter what YOU think? DENIED.
Want to bet you'll be made the fool for even suggesting such a photo? And how long do you think it will take for the judge to see right through your game and award him custody for your apparant manipulation of the court?

By the way, just so you know, what you are planning on doing is punishable by a $1,000 fine and up to one year in jail unless the court decides to charge you with felony perjury, falcifying evidence then you're talking about a criminal records and a lot larger fine and jail time.

You need to stop this and realize that unless he is truly an unfit father, drugs, negligent parent skills or violence, he is entitled to see and parent his kids. In fact, he has equal rights. The courts could likely not care at all about this photo and think poorly of you and your maturity in pursuing this ridiculous claim. Get beyond the bitter and the courts will be a fair arbiter as per the law.

The judge is going to look at context....cross-dressing at a Halloween party is hardly unusual and certainly not proof of some sort of perversity...certainly since he can produce witnesses to SAY it was just a Halloween party.
In fact, the judge is very likely to look badly on YOU...that you'll make up any crap story to make him look bad actually makes YOU look worse. That and the fact that you think the judge hasn't seen it all before and is kind of an idiot to think "costume = perv = unfit."
