who deserves the parking spot? Does a person standing in a spot waiting for a friend have the right to hold the spot for them even though your car is there before their friend?

Unless the person standing there has a license plate attached to their rear end, they do not belong in the space and the car that arrives there first can park there!!

GREETINGS, well it's not really about who deserves it but what the law allows. A person standing in the spot is loitering and blocking access to public parking, so the motorist should legally get the spot. Doesn't seem fair does it? I would think most people would pass by someone standing there figuring the spot was saved and really since the standing person found it first they should get it but the law doesn't think that way....logical.

Of course it's the guy in the car. The person standing in the parking spot is impeding traffic and he/she should move out of the way. The parking spot is first come(FOR THE CAR!), first serve (FOR THE CAR!) .

BE SURE to write his license plate down if he does in case he does slash your tires or if he keys your car.

Some of the response people wrote are just plainly stupid. They have never lived in the city before.

I guess the person in the car, but wouldn't you feel bad if you bulled the person standing there out of the way only to find he/she was trying to hold a decent spot for a young mother with 2 babies who was coming along right behind you? Personally I can't be bothered with parking lot arguments and park on the outskirts away from other vehicles. Faster to park, faster to leave, and no dents in the door!

Besides, you bull someone out of the way, you are likely to come back to your car and find a mirror missing, or a tire with the air let out.

I'd say any motorist who came along, since a car weighs about two tons and most people weigh less than 175 pounds. This is a clear cut case of "size matters" (or "might makes right!").

If a person was standing in a legal parking spot reserving it for someone else, I wouldn't hesitate one minute; after hitting my horn once to warn him, I'd just run him over!

I'm going with the person standing in the spot. I could be wrong because I've never encountered this sort of thing before. Here in Toronto, we're too lazy to get out of our cars to do such a thing so we decide to be as$holes and just park at the fire zones with the engine idling for an hour.

I think it goes to the person standing there. Who cares by what means the spot was claimed - by body or by car? It was found and saved by the friend.

I would never be so rude as to attempt to run over someone standing in a parking spot - not to mention, it's theoretically a crime to even threaten to run someone over with your car.

Damm I hate this kind of petty sh*T. Not that it doesn't happen to me but that people are forced to live like this. Living packed into cities like sardines fighting for "space"!!

Just so you know, I lived in NYC for almost all of 44 years and I am so sick of this crap. But if you decide to take the spot (no matter who deserve it), the other driver can and will comeby and scratch your car. So don't think you've "won" just because you got in.

I think the person standing there. First in, first serve. I certainly wouldn't expect to take the spot if I saw someone standing there, but thats just me. A little like someone reserving a spot at the cinema, or a cafe.

This happened to me last week. I played like I couldn't see the friend and practically ran her over. I don't have time for this kind of thing... the spot is yours when you pull your car into it.
