I'm 17yrs. and I need to keep my ex-boyfriend away from me because im scared he might hurt me. So they told me about the restraining order. So what do I have to do? and do I need my parents? and what else to they do? Im really scared.. Can you please help me soon..

Legally, you don't need your parent's permission to get a restraining order. BUT, it is advisable that they are fully involved. I don't see why you don't want them to help you protect yourself.

To get a restraining order, you need to prove to the court, you are afraid for your safety (or life), and you have a credible evidence that the person in question might hurt you. In another words, just because you *think* he might hurt you is not good enough. As you are asking the court to take away someone's right to be at some place, you need substance to your claim.

If you have a note, recording, witness, or anything that directly ties the person to a particular threat that he made against you, that is usually good enough.

Once you have a restraining order against someone, that person is not allowed to come near your home, school, or any place you frequent. They are also not allowed to call you, mail you, or in any way have a contact with you. Once they do, they are in direct violation of the order, and they can/will be arrested.

Stay safe, but remember, you are taking a legal action against someone. You have a responsibility to use this privilege with care and fairness.

The first thing you should do is to let your parents know. The second thing is to contact your police department. If the threat is not immenent, don't call 911. Call your local sheriff's office's regular number, and ask to have a deptuy contact you. He will know what to do.

If you start bugging them like calling and texting and showing up at their house, they can get a restraining order. You don't want that. People will think you're a nutjob. Since you're having the baby, you're going to be too busy to be stalking your ex boyfriend. You could take the ex to court for child support, but would it be more trouble then it's worth? How much could the kid even afford to pay? Of course, at 19 and 17, it usually seems like you're in love. What made you think you were in love? Maybe you were, but that all changed when you got pregnant. When you say he can't "go on living life like this hasn't happened". You sound all "Fatal Attraction". That type of attitude will get you in trouble and also the restraining order. Think of it this way, he's your ex and he doesn't care. You can't make him care. If you don't care if he's in your life and you want him in your child's life, then forget about him. You are choosing to let your child live. It will be a lot of work, but don't fill your thoughts with this jerk. But with you being 19 and having a 17 year old boyfriend, why didn't you take precautions to not get pregnant? Did you get pregnant on purpose? The reason I asked about you not taking precautions is because you might say you forgot. Or some other excuse as to why. But you're going to have to stop forgetting because you're bringing a new life into the world and you have to be on the ball. You can't forget things you need to do or should do. Time to grow up. It is so much better to have your parents help you get a restraining order, because your house will be a safe haven. They can make certain perameters around the house in which he can not breach along with a certain distance the guy needs to stay away from you. Your parents have more legal power, and can keep a better eye on both of you. Depending on where you live, you may not even be able to fill out the forms by yourself until you are 18. But be careful about what you go about doing, and consider putting a restraint on any of his friends if they start to make you uneasy too. I have seen that happen in school. Two kids can go near each other, but their friends carry out the dirty work, and have your calls and online action monitored in some way. And save everything!

In addition to what the others have told you, please remember, a piece of paper will not stop a bullet, a knife or a fist. Someone who really wants to harm you will not be deterred by an order. You should go to the police and your parents. You should get the restraining order and once you have it, call the police immedicately if he violates it. But, you must do all you can to protect yourself. People violate restraining orders every day. They're only as effective as your use of them.

Contact the police first to let them know. Then get your parents to help you with an order. Legally you can't sign anything at 17, and thus you'll have to have them file the paperwork for you.

Some state will allow you to get a lawyer to file on your behalf without parents, but generally this will only be allowed if the parents are the parties to which the order would apply, or are otherwise disregarding your safety.

hay.. im not to shore about the restraining order but not to long ago my parents put a tresspasing notice on my boyfriend hense why im not living with them lol. but how it works is you have three forms exactly the same. you have a copy, you fill out the second copy and give it to your ex, then you give your last copy to the police. they will have it on record that way. your ex bf wont be able to come any closer than 100 meters to your house. if he does you can ring the police and they will deal with it from there.

please turn off the computer and go see the police now with or with out the parents yes they will help dont get killed it happens every day go now!!!!

you and your parents need to go see the police NOW. you might be scared to go there, but you have to. terrible things happen to girls because of abusive and/or crazy boyfriends, so please please don't take that chance!
