I have a court date coming up (minor) and this cop stops me right, and he was so mean. He stopped me because of my tints where to dark. I tired to explain to him that my daughter has Eczema and I rather not have the sun on her skin. He would not even let me finish what I wanted to say. He was like "tell it to the judge." Man I pray he don't show up! He gave me a $60.00 ticket for tints and I also tried to explain to him that a cop had already stop me a few days before for the same reason and he just gave me a repair order. I had a doctor's note in my car and he did no want to see that either. It stated that the baby has bad eczema. I did not get a public defender. But what should I do? Like plea guilty if he is there and explain my story or plea not guilty.

If you want a chance to explain to the judge, you'll have to plead not guilty.

If you plead guilty, you do not get to explain anything. You must plead not guilty and then you will have a trial.

The cop will testify and explain the reason for giving the ticket. You will tell your side.

You will probably lose. Here's why:

1. You don't get to break the law to protect your baby from the sun. This is not a life threatening condition and there was no emergency health problem. For example, if you are speeding to a hospital because your daughter was bleeding to death, it might be an emergency that "justified" breaking the law. But you had other choices. Your child could wear protective clothing. You could put a car window shade on her side of the car. Just two examples.

2. You were already warned and received a fix it ticket, but you refused to fix it! Instead, you drove your car again, knowing that it was against the law. This shows your intent to break the law. Not good.

Before you go to court, remove the tint from your windows, plead not guilty, explain why the windows were tinted in the first place and present your proof that they are no longer tinted. You might be found guilty, but possibly avoid the fine. You are basically throwing yourself on the mercy of the court.

Then use your noggin to protect your child from the sun in the future, without breaking the law.

i think you should talk this over with a lawyer who specializes in traffic cases . Man I do feel for you . I guess that cop had a pretty bad day . In most cases though they dont even bother to show up . But I would show the drs note to the judge more than likely the judge is going to throw the case out since you have a drs note or he will make you take the car and get a lighter tint . I wish you luck anyway .

if it is your first appearance, you will need to enter a plea, if you go with guilty, you admit that you are at fault, if you go with not guilty, they will reschedule for trial, unless the judge asks you to explain the situation, whereas he may let you off, but you better have evidence such as documentation to back up your defense. you may also contact the district attorney office and explain your situation, they may be able to get the case withdrawn before it goes to court, or if you have the finances, hire a private attorney, and they can do it for you and have a working relationship with the courts, so they know the loopholes and the right people to talk to

Talk to your lawyer, but I would think to plea not guilty and make sure that you have that doctor's note to present to the judge.

Get medical records from the doctor to prove your child's medical condition before going to court, make extra copy to give to the Judge or your attorney to give to the Judge. Never go to court without a attorney.

Plea not guilty, as long as you have a doctors note. Thats all you should need!
