I assume they are not his kids because filing would be simple. If you had the kids (you said my not ours) before you married that might all depend. Are the kids already naturalized and want to become citizens? Are you a citizen or naturalized because if so it would be you doing the filing.

If you are illegal there is no guarantee. It is hard enough for a women to get a green card herself if she is already in the country illegaly. The simple and common solution to this is the wife goes back home and then the husband files for you. That way you have not started out having broken a law.

If that is the case you may wish to find out more before you start filing anything as your name and status will come up. If you are not legal and he is filing for adoption...... same thing. But if you are legal and he files for adoption...... yes they will become citizens as they would now be the legal child of a citizen.

When your husband files he would find all of this out. So as I said.... without more detail it depends.

Depends on where they were born. If born in USA then automatic citizens. Otherwise if the dad's petition is approved then the kids become naturalized citizens.

Were you married when you had the children or is your husband to father of the children? If either of these two cases are correct, then they are likely US Citizens.
