In my experience, I'll have to say YES!!
In order for someone to be able to take a child from the mother, they must prove that she is unfit, a drug addict, or even worse. As long as the mother takes care of her child, and does the right thing, she'll have nothing to worry about.
The mother of my daughter went through 4 marriages, all with really horrible men that would abuse her, and my child, and I was never able to get my daughter in my home.
It took her mother's suicide to accomplish that, and then her family tried to say that I had no rights towards my daughter, but I won, and spent the last 10 years with her at my side, and to tell the truth, the cost was just high!!!
I would gladly lose her to her mother as long as she would have stayed alive. It has been hard on my daughter, losing her mother as she did, but she has grown up to be a fine example of a young woman, and I'm very proud of her, and love her to death!!

In most cases that's the case unless there is substantial evidence which proves that the mother is unfit to take care of the child or children and that the father is the better alternative to taking care of the child or children who the custody battle is over. Or in some cases it's about who has the better lawyer as well.

depends on the judge....but it usually is the mother. around here they wont give complete custody to the dad unless they can prove that the mother is extemely unfit.
