You really should have an attorney for this so that you are headed on the right tracks. Laws vary. Where was the child born? This is going to be important. My girl friend is divorced from her husband. They set up house in his home state and then had two children. Because the children were born in that state she is not allowed to move out of state with the kids unless she has his permission. I understand that usually is the case in most states. Be careful. Do it the right way because believe it or not even though he is your child-taking a child out of the state from his father without his permission is called:Kidnap. The advise would be free if you would go to the courthouse where you live and have someone lead you in a direction you need to go. Good-luck to you and I wish you all the best for you and your son.

Look into your state laws first, since that is where you should be filing. There are a lot of online resources, just do some searches, and you'll find what you need. Or hire an attorney, if you have the money.
