Depends, If they can demonstrate during the incident analysis that the accident was avoidable and happened due to your negligence, then they might be able to justify the discipline. But if the accident occurred due to faulty equipment, poor safety equipment and procedures, or poor safety training, then most of the blame should fall on the employers shoulders. I would inquire with management as to whether the accidents were OSHA reportable. Some companies try and skate around the OSHA guidelines in order to not have to pay fines when a preventable accident occurs. You may get them to back off on the discipline if they feel threatened that you may go to OSHA and report the accident, or the DOL, and file an unfair labor charge.

It is common policy to have meetings with employees whose attendance is poor. If your wife was off for 2 weeks after that accident, then she would have had to have gotten a sick note from the hospital or GP. So that covers that - details of the accident aside. As to the other incidences, well you don't give details on them Not sure what you are really asking here ? For comments re the situation surrounding the accident or the fact wife being disciplined If her other 2 absenses were genuine, then she has nothing to worry about

Ask yourself why you are having so many so called accidents, it could be a medical condition.
However if I as a manager had you as an employee with a bad accident record I would take steps to find out why.
For the sake of other employees and yourself get yourself checked out at the doctors.
Better still resign and get a job making sand castles on yer own of course.

If your accidents occur too often, then you become a risk to the company. They cannot fire you, but demoting you is their first step to getting you out of the door. Truth is, there isn't one business owner who would tell you they enjoy having an accident prone person around that will cost them money. Plus they may think your accidents are intentional.

I take it you are from the UK? Any disciplinary action taken against you by your employers on the grounds of health and safety is automatically unfair at tribunal, unless it is you that hasn't complied with the companies rules and procedures for health and safety and this is what is causing the accidents.
In such a case, your employer could construe you to be guilty of gross misconduct.

Hi,If the accidents were their fault, and you can prove it, then they cannot discipline you.
Have they given you training on safe practices for the work you are doing?
Do you have a disability like dyspraxia that they should take into consideration ?
Join an union and they will be able to help you further.

Don't know what kind of work you do but you can be disciplined for too many accidents if the accidents are caused by your negligence.
As for their negligence report them to health and safety , they won't like it so do it anonymously.

not knowing exactly......assuming its serious, ask what OSHA say to do to fix this? warning: thats like handing somebody a cardboard box, containing 6 rattlesnakes. there not going to be a happy camper, but in the work place its safety first, reguardless of wheather they can afford it or not, my fingers arent buyin you a new set of tires............

Check your contract or company manual. It's entirely possible there is something in one of those that you signed or agreed to that states they can.
If so, there's nothing you can do about it.
