I moved out of my brother's house & went to a shelter because he was beating on me & taking my money & stealing from me & invading my privacy. Since I just moved out on Friday, I didn't get a chance to get a PO Box yet. I had some very important mail that was supposed to come, regarding my food stamps. If my brother refuses to give me my mail, is that a criminal or civil suit?

Tomorrow, I WILL be going to get a PB Box. I need to return his keys, but I'm afraid that if I go to his doorstep to return them, he might either hurt me or just straight call the police on me. Do you think I would be safer to return the keys to his landlord? I just found out that he had me living with him illegally & didn't even put me on the lease.

He took the money I gave him for rent & spent it on partying with his friends & buying cigarettes & pizza & had nerve to not share any pizza with me. Now he's wondering how the rent, lights, water, phone, etc. will be paid.

Yes it is a federal offense to tamper with another's mail. However your brother can lie and say that you did not come for your mail, etc. What you need to do is contact the agency that issued the food stamps and your other important mail and make arrangements for them to hold the mail. GET THAT POST OFFICE BOX - DON'T FORGET OR GET TOO BUSY.

Do not return the keys to your brother. Wait until you are sure he is out of the house and return them to the landlord.

In most places the police will come with you to a place you have moved out of to pick up your things. See if they will meet you and you can look for your mail.

Too bad your brother is wondering about how his bills will be paid. He should have treated you better.

Tape the keys to a small peice of cardboard that will fit into an envelope, and mail them to him.

And yes it is a Federal offense to tamper with anyone else's mail. Talk to the Postmaster for that particular Post Office.

Your brother cannot legally keep, open, or throw away your mail. He could get into big trouble if he did. Mail theft and related crimes of fraud are very serious matters. Put an immediate hold on your mail so no more gets delivered before you get a P.O. box. Contact everyone who sends you important mail to make sure they don't sent it there. Double check if anything is missing.

It is illegal to INTERFERE with the delivery of the mail. Once delivered, the duty of the Postal Service has been completed. Regardless of the name of the recipient, disposal of delivered mail is strictly at your own option. Look at it this way: How often do you get mail addressed to Occupant? Or Current Resident? Is that YOUR name? No, the law does not ASSUME common sense or logic. Plain and simple, their duty is to deliver all mail to the intended ADDRESS, not the name. Once delivered, the person residing at that address can do what he wishes with any and all such mail. Besides, on the REMOTE chance that the previous occupant came back after a couple years and attempted to sue you (civil, not criminal, court), he'd still lose handily since HE took no effort to forward his mail, nor to notify the companies of his change of address. YOU are not required to operate as a storage facility, nor as a forwarder, of misaddressed mail for others. As a courtesy (only), I do mark such mail as "Moved" or "Unknown" simply to let the senders know that the address they have on file is no longer correct. This usually serves to eliminate much of that kind of mail. After awhile, any random pieces still coming through just get thrown away. Lastly, you can tape a label to your mailbox that specifies YOUR family name Only, and most carriers will intercept and return incorrectly labeled mail on their own.

tampering With mail is a federal offence..If you have to go back take someone with you for your own safety. If you mail the keys send by registerd mail signature required Good luck

I would have your brother arrested for the assault. I would ask the police to give him his keys. If he has your mail than he is committing a felony. I would swear out multiple warrants against him if I were you. All you have to do is call the police and swear out a warrant under the Family Violence Act.
I do not care if he is your brother, father, sister, mother or a perfect stranger you defend yourself from violence.

You are better off not being on the lease. Not all residents of a leased home or apartment need to be on the lease.
