Workers' Comp should be kicking in here. Also, does he have short term disability insurance? Call the HR office where he works and schedule an appointment to see what they can do to help you.

Also, if it's time to make the payment and it looks like it's not going to happen, you absolutely MUST contact your mortgage company before the payment due date. They'll typically help you work out something that's agreeable for them and you. If you don't contact them, they'll report the delinquent payment to the credit rating agencies. It'll ruin your credit and make them less likely to accomodate you in the future.

Call the lender immediately. If your husband was hurt at work, there are undoubtedly disability payments coming his way shortly (short term disability, Workman's Comp! Something). On top of that, you have a medical malpractice claim! Please call the lender before you get too far behind. Maybe they can "rollover" a payment or two until other funds start to roll in. Good luck!

Maybe take a second job, work over time at your current job, call your mortgage company and ask about lower your payment. Maybe rent out a room in your home.
