We are told if we want to smoke we can go outside but the time must be made up, unpaid and half an hour at a time. I feel this is directly discriminating againt the smoker. We can take a walk around (as long as it's inside the building) It all has to do with leaving the building. What do you think?

If you are in the U.S., laws vary by state. Here in California, workers are entitled to a 10-minute rest period for ever 4 hours worked plus a 30-minute meal period if the shift is over 4 hours. You are not entitled to extra rest periods if you are a smoker. What you do on your break is generally your own business.

I contacted the labor board one time when my husbands employer decided to take their first and last 15 minute breaks away and was told ,that there are no State or Federal regulated laws that say that they have to let you have brakes.So in other words they can work you like a dog.It`s not fair i know that.Yeah they do pick on us smokers to much.

If you work an 8 hour day in the US ,you are entitled to two 15 minute breaks and a 30 minute lunch. Thats the law!

No they can't take you breaks away. For every 4 hrs you work you are to get a 15 min break for every 6 hrs a 1/2 lunch and so on. Check with your local employment board more more information.

According to what I understand about US Labor they don't have to give you breaks but if they do you must be paid on the breaks unless you don't follow the time limit.I think you should explore the website on my source to verify for yourself.Good Luck

It's not right, since taking a walk can take more than smoking.
But If the order came from the boss, you can't actually do something about it, only suggest him something. The only thing you can do, is to get another job.

if you work 8 hour days. you legally have to have a break.

legally ...no they cannot.....but they probably have figured a way to get around that rule.....check the company handbook.
