I have a tenant that is very non-responsive and always late on rent. I asked several times if he would like to renew the lease and they said no , so I signed up new tenants to move in after his lease is up. This is a collage student and I e-mail receipts to him and his parents. What concerns me is his parents are under the impression that there son was intending on saying another year. Bottom line his lease is done in about 7 weeks. I want to ensure he is out no later than his last contract day. How can I assure this?

Send him an e-mail, and copy his parents, telling him that, based on his telling you he was not renewing his lease, you've made other arrangements for the residence.

Let him know that, "...you'll need to have the residence empty of your personal property, clean, and ready for my final inspection no later than 12:00 noon on July 31, 2007 to ensure you'll get your security deposit back. Please let me know if you plan to overstay, so that I can convert your rent to the higher daily rate that will begin after 12:00 noon that day. The daily rate for rent is ..."

Also print the e-mail out and mail it to him, certified mail, return receipt requested. I'd recommend making the daily rate outrageous - something like $500 a day to make sure you get his attention.

"Telling" and "E-Mailing" won't cut it! Send him WRITTEN notice via Certified Mail, return receipt requested, that you will not be renewing the lease and instructing him to be out of the premises by the last day on the lease. Send this notice to whomever signed the lease. Virtually all leases call for written notification. Verbal or e-mail notification is NOT sufficient. He can ignore it and will simply be a month-to-month tenant at the end of the lease.

This won't guarantee that he'll be out, but it will form the basis for eviction proceedings if he doesn't vacate on time.

Sounds like you've been too nice to this person already and he thinks you're a 'softy'. Time to get tough. Let his parents know what is going on and also and have a 'Notice of Eviction' ready to hand him on the date his lease is up. If he has no lease, you have the right to call the police and have him removed. I do hope you have a security deposit, because he sounds like the type who might try to screw you over.

A letter to his parents detailing that he turned down signing up for another year of lease and that he is expected to leave on a certain date is a good start. Explain that since he had not signed up for an additional year yet that it is now too late to do so.

Additionally, you might help them to set up arrangements for a moving van and/or movers to help.

send them both reminders with the last months rent reciept,,,remember Billy, your lease is up, and you have to be out on the 30th of June. New tenants on the 1st............????
