I would contact the IRS and let them know what's going on. No matter where the child is the absent parent is supposed to support the child. The person who is allowed to file for the child tax credit or EIC is the parent who has custody of that child, other wise it's tax fraud and he will get into big trouble, having to at least pay back the taxes he was refunded based on his fraud.
I would also contact someone about his threats to you about returning to the states. Probably INS. I'm sure they wouldn't be too thrilled with that.

The parent who has physical custody for more than 6 months is the only one legally elgible for tax credits. Let the US Federal IRS know of his actions to defraud and then the US Attorney General or District Attorney of the city he lives in. Make sure they also know about the threats he has made against you if you return to the US.His actions are totally illegal, but what you do with this information is up to you. Good luck

I think either parent can support him but if you aren't claiming him in the US there is nothing to stop him. Check with a tax person. He sounds like a jacka**. Are you trying to get back into the US? If you do come back just make sure you have child support papers written up and if he harrasses - get a restraining oreder.

In order to claim your son, he has to have lived with his father for more than six months out of the year. Therefore, what he is doing is illegal. This is what I got off the irs site for reporting such activity:
If you suspect or know of an individual or company that is not complying with the tax laws, you may report this activity by completing Form 3949-A. You may fill out Form 3949-A online, print it and mail it to:
Internal Revenue Service
Fresno, CA 93888
If you do not wish to use Form 3949-A, you may send a letter to the address above. Please include the following information, if available:
Name and address of the person you are reporting
The taxpayer identification number (social security number for an individual or employer identification number for a business)
A brief description of the alleged violation, including how you became aware of or obtained the information
The years involved
The estimated dollar amount of any unreported income
Your name, address and daytime telephone number
Although you are not required to identify yourself, it is helpful to do so. Your identity can be kept confidential. You may also be entitled to a reward.

Hum, that is a hard one to answer - no he is not entitled to claiming child tax credit when his child is not even in the country! Report him to the proper authorities or the taxation centre in the USA (I'm Canadian). With his new love, I'm not sure what you can do as you probably know nothing about her - lets hope she doesn't fall pregnant. Sorry I am not being much help I know - just feel badly for you. I doubt it is legal. But why did you take his son and move to Pakistan? That doesn't seem right, either! You have deprived your son of his father, and a father of his son.
Still, if he is not paying child support (which I don't blame him if you've kidnapped his son), he should not be claiming him as a "dependent" on his tax form. However, how would YOU know that is what he is doing?
If you are not legally divorced, he cannot remarry without breaking the law. But he may have been able to divorce you without your knowledge, since you have left the country.
