I want to start up my own company. I have its name and companys symbol and want to make sure the name and symbol remains mine. Is there a way to copywrite this so early in the life of my compay?

I'm assuming you are talking about obtaining a trademark or servicemark. You can register in your state, which is cheaper, but provides limited protection. You will have greater protection by registering your name and logo with the United States Patent and Trademark Office. The link I've provided below goes to their FAQ. You want the information on Trademarks and Servicemarks. Trademarks are for companies who sell a product; servicemarks for those who sell services. You will first have to use their search to see if your company name is already taken. You can either file yourself or use a trademark attorney. Of course, using an attorney carries additional costs. Even if you apply yourself, you are looking at anywhere from $275 to $375 to protect your company name.

One last thing. If your name is taken, it's my understanding you may still be able to use it. That's where the knowledge of a trademark attorney may be helpful though. As a marketing director, I was in this situation before, and was eventually able to use the name. However, it took some letter writing on the part of the attorney, and I'm not sure I'd want to undertake that as an individual.

You can trademark and copyright anything at anytime even if the business hasn't made 1 penny as of yet. Incorporate or LLC the company name and copyright the symbol (the name can also be trademarked.) I actually waited a bit to long to and when I finally did someone else took the name.

You can copywrite anything as long as no one else has it.

Lots of people copywrite name without a company so that when a new company comes along and want that name when they try to copywrite it they find out it's already taken and then the person can sell it to them for a very healthy profit.

So copywrite it now, then build your company
