The examples you cite are certainly worst case scenarios, and common sense must be applied. Freedom of speech, as it has been observed by much wiser heads than my own, does NOT include the right to shout "Fire!" in a crowded theater.

Now, as to when freedom of speech should not be allowed, that's a very delicate question. On the one hand, you have sickos passing around kiddie porn on the web, but at the other end of the spectrum you have people who would ban some classical paintings by the great masters because they depict what appear to be naked, flying babies (actually representing cherubs or cupids). You can see the difference, I'm sure.

I'll agree that there are times when freedom of speech must be curtailed--for example, if you have loved ones in Iraq, for the most part they can't tell you where they are precisely. Neither telecommunication nor computers are so secure that the information could be prevented from getting into the wrong hands or ears and result in all kinds of havoc. I also feel that it would not be responsible to issue a parade permit for American Nazis to hold a march in a Jewish or black or other neighborhood that they feel is occupied by "undesirables."

I'm sure that this answer doesn't fully address your issues, but your question is quite thought provoking. I seriously doubt that I am capable of answering it as fully as you would like.

I read the comment above by Michael that
"As for freedom of speech stops as soon as you start preaching hate and violence."

Only problem with that, is the pedophiles standing outside school shouting sexy legs is not preaching hate or violence. It is seducing them.

It will be very hard to create a framework that encapsulates all the things one should not say aloud.

I guess people just need to exert more social responsibility.

Freedom of Speech has it's limits... of course, there are laws that protect us against those type of behaviors. you may not be able to send someone to court for saying you have nice legs, but you surely can stop the violence of terrorists since they are being watched, especially KKK.... they aren't banned but they can't hold a rally that may offend the community... i believe they can only do it in places they are allowed... not, suppose, in front of the white house....

I sincerely believe such speech should be allowed. However, I believe we should also have the right to suffer the consequences of what we said to go with it.

Think about,

You pick up your kids and the teacher wolf whistles at your kids. Now you know who NOT to trust with your kids.

Allow terrorist to pass out recruitment pamphlets. Why? Would make it easier for our intell agencies for track who is and who these organisations lay and make even easier to infiltrate them to bust them up from the inside.

The KKK? Should be allowed as long they do not conceal their identity. That way you know who if your boss at work is a racist bastard or not.

In short, let these people express such things. When it is out in the open, they will be easier to track and figure out who not to trust.

This is too heavy for this time of night!!! Paedophiles should be castrated and have their balls stapled to their foreheads!!!! Terrorists should be grouped together and made to listen to the screams of their victims for eternity. Racists should be set to Africa or Israel with KKK tattooed on their foreheads one at a time. As for freedom of speech stops as soon as you start preaching hate and violence.

Speech has nothing to do with a persons actions, & you should consider that if some dont have the right of speech... all are forbidden... including YOU and this question.

Do you think we have freedom of speech?

Incitement to murder or riot are illegal.

There are race, and religion hate laws (UK) curtailing your "right" to be abusive to these groups.

Convicted paedophiles are specifically banned from school areas and talking to children.

So all the examples cited would in practise be unlawful.

The things you listed are all valid points and no these people should not be able to do that. But think, without these evil people shouting from the rooftops we wouldnt know who the enemies of our society were. If you are pre warned your pre armed.

If it was banned you wouldn't be able to ask this question. People who try to stop peoples right to freedom of speech are as bad as paedophiles, racists and Nazis.
