I work at a restaurant. Sometimes, customers make a mistake on adding up the numbers. I don't know which one I should rely on. Anyone knows, by law, which one has higher priority between the tip or the total...

The total over all has the highest priority. Tipping from there is the own persons decision. The total has to be paid by law but a tip is the decision that people make. If its great service then 15 percent or more of the total should be given. One great thing. Theres no law that says people even have to tip.

I've come across this on both sides of the coin. The total does not count, at least in the cities I've worked in. and yes it's a local law when it comes down to it. I've had people forget to put a "dollar" amount on the tip but write a total in with like 25 to 30 percent which would be a tip, and if you turn it in that way without filling in the blank, depending on your manager, you can get zero. I've also have gotten a $50.00 tip on a 25.00 bill because they clearly marked the tip and did not add it up. These days every thing is electronic and the only people that see the actual written copy unless the customer disputes it is you, and your manager after you pull it from the table. I always enter what I believe is the "true" amount and cover myself. They use your pen after all and bottom line is nobody is going to court over a few dollars so take some extra and also don't fret over losing a few bucks either.

I was told in training to take whatever's lower.

EXAMPLE:

Base: 31.30
Tip: 5.00
Total: 30.30
I take only 4 not 5.

If they say

31.30 Base
4.00 Tip
36.30 Total
I still get 4 not 5.

I don't know by law. Most of the time I take whatever they write in the tip blank. Their fault the math was wrong.

you have to go by the total. if they added wrong, its really their mistake, but as a place of imployment you are suppose to do the right thing and go by the total.
