I havent had hot water since june 1 st, the toilet is leaking from the bottom. I keeo gettting the brush off every time i mention it to them. i was told that the water heater is in need of repair, thats not my problem.

You cannot withhold any monies owed to the landlord for any reasons in most States, this will only get you evicted. Maybe this is what he wants?

Go to him and personally ask what his problem is, if you don't get a response then, check with your codes division through the County. Tell them the problems your having. Most States do have ordinances that require hot water and running toilets in working order, in order to rent or be habitable by humans.
When you get the facts, then you have ammunition to fight with. You can tell him what the ordinances read once you find out. Be prepared for a fight and possible termination of any lease but, you may be able to fight it through the renters authority in the State or County if you have one. If not and, your at the wet end of the rope? learn to live with what you have or, move.

No....don't tell your landlord you won't pay rent until he fixes it. Are the things he/she is not repairing causing the home to be inhabitable? If not, then he has a right not to fix them. If they are causing the home to be inhabitable it is his/her duty to fix the issues. If this is true, and he doesn't fix them send him/her a letter in writing specifying what needs to be done. Ask him/her why he isn't fixing them. You need to keep communication open. Landlords can't fix every issue that every tenant has as it is not financially feasible. They do have a responsibility though to make sure your apartment is safe and habitable. If not there are other avenues you can choose. Also, if it is that much of a pain you could give your 30 day notice. Most likely, it will not be worth going to court over. Plus, if you don't pay, you will be evicted.

send him a registered letter as evidence that you informed him of the need for repairs. If he refuses to repair them then in most states/municipalities you can withhold rent and use it to pay for the neccessary repairs like the leaking toilet and the hot water heater.

Hehe, Interesting answer's from those ahead of me. I'd try to get the landlord to fix the problems and if he isn't the owner you could go to the owner stating your case. Then give your notice that your moving in 30 days if nothing happens.

Withholding rent monies will only get you evicted. Unless you just have to have this place to live there are as with girls plenty of fish in the sea to choose from of all shapes and sizes.
