The couple is issueless and the husband has a fixed income.They live in India.

It should be 20% of the fixed income of the husband. Vijay M has outlined well enough. In one instance in Roman court denied any maintenance allowance in a particular case. The court determined that the lady in question had not perfomed any marital duty and responsibilty to claim any maintenance allowance.

O.K. The amount of maintenance allowance definitely depend on the income of the husband, it also depends on the income or source of income of the wife any if she has, it also depends on the responsibilities of the other family members of the husband & definitely children but in this case the couple are issueless then this will not be under consideration. The wife if she owns any property or expects any property or other source of income in future is also taken in account. The amount of maintenance should be reasonable & just as it should at least provide the wife all the reasonable facilities of life she was availing during her marital life, this does not include any excessive expenditures that she was indulging that may be look extravagant in nature but they must be those that will lead her to lead a decent life after her divorce. Now as far the range of this can be any thing from 1/5 to 1/3 of the income of the husband on monthly basis or if the parties agree for a fixed amount during the pendency of this maintenance proceedings that will be paid in one go or in installment as agreed for the permanent maintenance or alimony.

I think it depends on the Lady's standard of living and what the husband can afford. But u might want to check with a lawyer.
