Its overlooked by other houses but its my garden right, and I wana enjoy the sun. How does the law stand

the law says that if members of the public can see you then you could be guilty of lewd and libindous behaviour and/or offending public decency

and there is further. If you turned out to be a bit tasty so that a crowd formed then there is breach of the peace

if you are a bit of a minger then there could be charges of offending publice decency

so it's up to you really

If the public can watch you it's illegal, even if it's your own house. To make it more clear let me give you an example:
A man who lives on the school route is not allowed to stay bare naked behind his own window while children are walking by. He will be arrested in no time.
In your case, since it's your garden and only certain neighbors can watch you, and if nobody complains to the police then you are fine. But if they have kids and start complaining then you will get a warning from the police.
Another negative aspect of this is that if you have a mean neighbor, they could video tape you freely and even put the video on the internet! So be careful.
There was a case a few years back where this reporter would go around town and film couples making love through their windows (if they didn't pull the curtains) and he would distribute the video tapes (internet did not exist then). The case went to court and he kept winning claiming that it was their own fault to leave it open for everyone to see.

You are allowed to on your own property. Especially the back garden because it would be an individuals choice to look into your garden. If it was at the front of your house people could accuse you of disturbing the peace.

If you live in England, yes you can go topless if you wish to. However, you say you are over looked, so this may present problems with the neighbours, should it offend or annoy any of them . They can ask you to cover up or they may report you to the police or local council bye-law department. The courts could "do" you for indecent exposure ! Why don`t you put up some sort of `wind-break`/ shelter to obscure their view? I realise that this may be impossible if they can view you from an up-stairs window. It really isn`t worth `falling out` with your neighbours over it. Try to find a` happy medium`.

There was a case round here where some bloke showed his @rse at his neighbour he said to prove their CCTV was pointing at his property and he was arrested and charged with indecent exposure. he was a custody Sgt at the police station as well.

however your neighbours would have to report you I think if you found a quite corner of your garden you would probably be o.k
if your very overlooked then it probably best not to.

try and find a spot where your not overlooked, i go topless in my garden but only in a certain area i don't walk around topless as i think that it would be unfair on anyone who could see me, but sunbathing topless is completely different so go for it.

If it is naturally overlooked and those who may do so would be offended you could be on shalky ground.
Following your reasoning, you could equally say, "It is my top so I can show it if I like"
There are many places where you can go topless. Check with your neigbours...they may have no objection

It seems to me if a women shows her bits in her own garden and some bloke see's them then the bloke is branded a "PEEPING TOM"

However if it's the other way around and the bloke is naked in his own garden and some woman see's him then he's a "FLASHER"

i guess it's a womans world where that's concerned

Certainly! I promote nudity in the garden. May the snails grace you with their slimy smiles. If you are in your own yard I believe you can be completely nude.

male neaighbours will love it the wifes might come n scatch ya eyes out coz of there hubbies n kids but hey if u can handle it and dont mind women neighbours insulting you then go ahead
