My husband pays child support for his son. I am currently 7 months pregnant. My question is, if he were to go back to court, would his child support for his son be lowered since there is a new baby he will also need to support? Right now his support is $400/month.

Not sure how you came to the determination that I'm not with my husband - not the case at all. We are happily married and plan to stay that way. I was just wondering about the effects of the new baby and the support he has to pay now for his 13 year old son.

no it wont because his son who was here first will always be the first consideration because he had the family before you . It never goes lower just because their is another added child sorry .

the only way it could be lowered is if he gets a job where he cant afford to pay the $400

but even a McDonald's can pay $400

It will increase
but since i do not know your husbands income i will not know by how much

I do believe that if you get a lawyer and you are no public assistance what so ever
and if you have custody of your children you are entitled to 60 some % of his income for your children


he also has to provide health insurance for your children if it is available to him where he works


Good luck
be fair to the children though

you want him to have a nice place to live when they go visit daddy leave him with
plenty of food and money for daddy to spend on recreation for them

do not do or expect anything out of spite

No, the court will not factor that in at all.
