well applied for apartment left a postdated check for monday....im a single mom with 3 kids...passed there last night...and block was infested with gangs...what can i do....$850 check left but applications got my personal info....i need some legal advise.....these people should be telling tenants about neighborhood......

In the banking world, there is no such thing as a postdated check. Try to get a "stop payment" on the check ASAP. Hopefully, the check hasn't been cashed or deposited yet.

You can write a postdated check, but the bank will cash it when the check is presented, no matter the date, as long as the funds are available, and there's no "stop pmt." on the ck.

If it's too late for that, small claims court may be your next step. Actually, you don't have much of a case. You didn't think to drive thru the neighborhood at night before you ponied up the check? tsk tsk

Actually based on rules of many states landlords and realators can't comment on the area...its weird but its law.

If you haven't signed the lease yet you have the right to not rent there...but they are entitled to an application fee...but not to 850...$25-$45 is more like it

If the landlord won't break the lease, then you can cancel the check and just take a small loss on the fees. At worst you may be on the hook for one month's rent. Is it worth that to you to break the lease?

Legally a post dated check is not valid, if the taker of the check knows the funds are not available, therefore the contract is void...

Why not just endorse the back of a $100 dollar Monopoly bill? Since it isn't real (the rapture) it is only fitting that the money shouldn't be either!

They don't have to tell you about the neighborhood. They are in it to make money. If it's not too late cancel your check through your bank.

Get the check back or ask for a refund and let the landlord know that you toured the area and it is not a good one for your family.

your always suppose to check a neighborhood at night, before you put the money up...you might put a stop on it, deal with it later, if they want there costs....

Well if youre young and attractive you could always try to "hook up" with the gang leader. That way you'll be like gold, I mean either way I have a feeling youre gonna get passed around.
