In the US, you are encouraged to raise money for charity in any legal way (bake sale yes, prostitution no).
If you do not register as a charity with the IRS and your state, people who give you money cannot deduct it on their taxes and you cannot tell them they can.
If you are not registered as a charity, the money you make may be taxable to you, although you might be able to take a charitable deduction for the money you donate to the hospital.
Also, your town may require you to have a permit for the specific fundraising activity you are thinking about--the bake sale, door-to-door, etc. Check with your town or county business license department.

For a bake sale , church groups and schools often have a health department exemption for sales.

No it is not illegal to have a charity drive.
But you would want to speak with someone at city hall before doing it.
Some events that are done for charity may require a permit.
So it would be a good idea to speak with someone at city hall before scheduling an event.
