I was filming my dogs with my camcorder,and in the backround I heard car tires screeching and filmed an accident.The parties were arguing on the fault,but clearly there was no dispute.The question is can/should I sell the tape to the victim's ins. co.?I want to because they will without a doubt win the case if it was for this tape.

Why don't you stop worrying about who you should "sell" the tape to, and start thinking about justice? Clearly there was someone at fault. Why don't you do the right thing and submit the tape in order to have justice done. Think about it.

I have to agree with an above post. Once you mention that you have evidence, it will become a crime not to submit it. And I am willing to bet that requiring money as a trade for the evidence would be considered bribery. You will get in big trouble. You have no opportunity to make money, I believe. However, you have a chance to help provide justice. Do that, instead.

that is very hard to decide. but i think you should think about it as if you were in the situation and someone had evidence that could help you.

personally, i would give the video tape because i would morally feel wrong. you will never know how you would be compensated in the end.

but money is always nice to have (hmmmm!)

The correct thing to do is turn it over to the police department after you make a copy of if for yourself. You have evidence that can settle the case much faster.

Here's what will happen:

You will contact the insurance company. The will say no. Then they will subpoena the tape. If you dont produce it or destroy it, you will face criminal charges.

Go for it.

So sad your motivation is money. If you are so sure why not be a good citizen, and call the cops? They could sort it out- you seem to know you are lacking in the "Moral" category.

It shouldn't be illegal. As for selling it that is rather questionable...even if it is to the victim.

I think it is unethical to profit off of someone else's misfortune but it doesn't make you an axe murderer
