He can claim whatever he wants, but Child Protective Services will do an investigation and the truth will be uncovered. If he left against the parents wishes, he could be considered a "runaway" even if the parents know where he went.

To claim abandonment is not a wise move onhis part because unless one of the parents is willing to take him back in as he moved out on his own accord, he may end up in foster care or a juvenile group home/warehousing facility until he is 18.

He could try for emancipation, but he would need at least a part-time job and some good character witnesses to attest to him maturity and that he is capable of functioning well unattended, which from what you say above, would be a very short to non-existent list.

In some states, it could be considered child abandonment if his parents refuse to pay for his support while he is living with someone else. It has nothing to do with whether it was his idea to go or not.

Parents have a legal obligation to financially support their minor children--even when they have no physical custody rights.

If it goes forward, the attorneys will probably take your boyfriend's testimony to find out if the parents did abandon their other son, will talk to school folks, etc. In the end, if everyone is honest, the truth will come out.

He's 16, and the parents could just sign a few documents, and turn him into an emancipated minor, and tell him that he's on his own.
