A mere rape ALLEGATION doesn't mean that society should take it upon it self to condemn a person. If that were the case, we would all be going around alleging BS against people we don't like & expecting retaliation from society. But guess what, that's not the case; that's not what Due Process is about. So give the man a break; he's a great player and not a CONVICTED rapist - thereby leaving his "criminal" record untarnished and clean. So just like you and I, he is an INNOCENT person until found contrary by a judicial tribunal. Is it to much to ask of so called Bball "fans" to judge an athlete by his athletic ability and not by his personal affairs. At most he is an ADULTERER - something that the great MJ has been accused of also - the same great MJ whose "playing abilities" you haters use to discredit those of Kobe. So if you don't judge MJ as an adulterer, and instead refer to his as a great bball player, then everyone else, including Kobe, deserves the same respect. Thank you.

As to answers # 13 & 14, I truly appreciate the most insigtful approach the two of you have taken to explain your positions. That being said, we are not in any way endowed to determine fate in the hereafter: "It is possible for the Lord to look at us without seeing our sins because when he forgave us, he removed our sins as far as the east is from the west" (Psalm 103:12). And besides, we don't judge an athletes by his moral excellence, or lack thereof. We judge it on its entertanment value.

As for the legal argument, post #14, you seem to have researched this case. However, regardless of where the case is held, the legal standard in a criminal case is always "beyond a reasonable doubt," and not "preponderance of evidence." beyond a reasonable std. is very difficult to prove & burden is on alleging party. What does this mean? This means that no way in hell the Jury would have beleived that lying girl & she would have lost the civil judgment also - leaving her lying butt broke

You settle out of court for two reasons: 1) You just want to get the situation dealt with and over and move on. 2) You're guilty and don't want all the negative publicity and definitely don't want to serve time.

Kobe settled out of court because his lawyers saw that under Colorado law he was going to be found guilty of rape and would have had to spend at least 18 months in jail. (They had semen samples taken from the victim that matched Kobe, and they had photos of the victim taken that night and she had many bruises) Colorado, by most accounts, has the strictest rape laws in the US. His lawyers didn't want to risk the case going to court and Kobe being found guilty, so they settled out of court.

Also, an interesting development in the case, is that the victim's name was released to the press. In Colorado, the victim in a rape case has privacy and her name is never released publicly. Rumors at the time said the name was released by someone on Kobe's defense team but were never substantiated. Once her name was released, the press put a lot of pressure on her and thus she accepted the out-of-court settlement offer.

As far as your "downgrade" of sin to adulterer - it's just that. It IS worse to rape than to be an adulterer because rape is a crime involving physical injury. Being an adulterer doesn't diminish the fact that he acted like a 14 year old boy - he didn't think he'd get caught so he did something he KNEW was wrong. And when he did get caught he tried every trick in the book to deflect blame and not take responsibility for his actions.

Kobe is a great ballplayer. That being said, why do you think people refer to OJ as a murderer and Michael Jackson as a child molestor? Oh, did you see the thing in the news recently about that guy that was behind bars for 20 years for rape and then recent DNA evidence proved he was innocent so they let him out?

The courtroom isn't right 100% of the time. Strange how people with tons of money and fame often get off the hook and some poor average guy got thrown behind bars for something he didn't do.

He is guilty of adultery, but I'm 95% sure he's innocent of rape. He will have to answer to God some day for adultery, but rape will not be on his conscience.

It also really bugs me when people say, "He's innocent because he's a good athlete," or "He's guilty because he hogs the ball." Wish people would keep their language clean and say what they think. Fine if you don't agree with me, but please have legitimate evidence to back up your claim. Here's why I think the way I do:

1. Semen AND pubic hair from another man was found on 2 pairs of her underpants AND her body the very next day. It's highly improbable that the forensic experts made the same mistake 3 times. She said to the police that she had intercourse with her boyfriend 4 days earlier, and also, no traces of the DNA were found on Kobe, so it was most likely deposited there AFTER they were together. The woman's boyfriend also refused to provide a DNA sample.

2. Just 1 month before the case, she tried to commit suicide because her boyfriend wouldn't talk to her. After the case, she was partying in Calgary (a Las-Vegas-ish city in Canada). She got drunk and smoked a few times there (This was on CNN and the newspapers, NOT some blog!!!). Why would her parents let her travel out of the country to party with people she has never met just weeks after she was raped?

Drugs, alcohol, cigarettes, and suicide attempts are fatal to one's credibility. Someone even said that long before the civil suit, she talked about how much money she would make. I don't know if that person is truthful, so let's give her the benefit of the doubt on that one.

3. World-famous forensic expert Michael Baden was hired by her lawyer, Mark Hurlbert, to check out her injuries. However, after Michael Baden said that the injuries could have come from consensual sex, Hurlbert decided not to hire him.

4. According to CNN transcripts, the woman is about 5'10" Kobe is 6'6" and his knee and shoulder were badly hurting; even months later, he was unable to play in the season. Why wasn't she able to resist him? 8 inches is a big height difference, but I'm 5'1" and 100 lbs. I know I can hold off a 5'9" person with only 2 healthy limbs.

I will only say that the evidence largely suggests that the woman was NOT raped. Only two people and God will ever know for sure. Of course, there is always the 5 percent chance that all these compelling facts are only coincidences, and that she is telling the truth. But I strongly believe that this was not a truthful claim. Whatever happened that night, both parties will have to answer to God for whatever role they played in the whole mess.

As an individual with some influence due to his place in the public eye, Kobe Bryant let a lot of people down with his poor judgment. People can forgive and forget, however, in the case of Bryant--his transgressions were magnified 10 fold--thus causing the backlash and labeling that you mentioned.
