my bf is being taken to court b/c someone is trying to sue him for 7,500.00. but he already bought a ticket to go to africa for the day before the case. the one suing him set up the date. but if he has proof of the ticket can he arrange anothor date? this is in the state of Ca. thank you

Its ok to change the date of ANY court date in Any state. You have to go to the court house, and request a motion to hear or motion to change the date. And request a lengthy date for your appearance. You have to file the proper paperwork. If you happen to be out of town, go to a local court house and request the filing forms, and then check online as to if you can email or fax the documents to the court house in the state that it will be heard. I believe you can request a 90 day delay.
But do this BEFORE YOU GO AND ALLOW TIME TO NOTIFY THE OTHER PARTY AS WELL.
You have to appear in court to ASK PERMISSION TO CHANGE THE DATE.

How convenient! Is he coming back?

He can motion the court for a continuance. It is usually the courts who set the dates, not the party!

You get a form from the court clerk's office and file it. You don't have to go before the judge to do it. See this link for more info.

He might. All he can do is ask. Has he been properly served????? If not, no need to go.
