If not then does the law differ for having sex in the dark?

One morning I found a used condom in my garden. Next to it was a bag with 8 cans of beer, a Twix, and 20 Lambert and Butler.

I can only assume some very horny people decided they couldn't wait till they got home and nipped into my garden for a quickie. And got so carried away they forgot about their goodie bag.

The beers went down a treat!

It is not illegal to have sex anywhere so long as it is not under-age, is consensual and does not take place in a public area. If you have other houses or properties overlooking your garden then you would not be able to engage is sex for fear of being seen and charged with commiting a lude act.

If you wait till it is dark than you are not so visible (unless you have intruder alert lights).

It is legal to have sex in the garden as long as you are not on exhibition for everyone to see, otherwise you could be charged with lude conduct. It's not about having the sex, it's about who else might be able to see you doing it. Don't you think a bedroom would be much better?

That really depends on what's in the sex. If they're sex of coal or maybe sand no problem. However if they're sex of body parts or sex of money knicked from the bank you could be in serious trouble.

You could be causing a statutory nuisance if caught or reported by a neighbour etc. Your garden is your property, but if you want to continue to do this, privatise your lovemaking area, so as not to affect neighbours etc. Enjoy.

provided both parties are consenting and above the age of consent, then the fact that youre on private property means you arent breaking any public decency laws however if one of your neighbours were to see you then they might be inclined to raise a complaint of lewd or offensive behaviour (my neighbours wouldnt though, theyd just stand perving)

Yes if your not being over looked by neighbours. If they have to meke an effort to see you then your not on public display. if you have windows that overlook your garden that it is illegal as they could inadvertantly see you.
