ok another hypothetical question that just poped in my head this morning on the way to P.T...
If an American is in America on the Mexican border with a high powered rifle and shoots a Mexican , who is across the bnorder in Mexico, would the American go to jail? if so where?

Interesting question.

It would be Murder on either side of the border; on the Mexican side because that's where the injury leading to death occurred, on the American side because that's where the primary causal act occurred.

If it were between two states, it would probably be given to the state where the death occurred, but Extradition might be refused if the Death Penalty were at issue.

In International Incidents, it would get more complicated, as there are treaties and diplomacy to consider, but most of all, Public Opinion. In the end, I would expect our government to give in and hand the person over to Mexico.
