My boyfriend, the father of my child is in prison and will be until our son is 6 months old. I heard the father has to sign the birth certificate in order to have his name on it. Does anyone know how I can have his name put on the birth certificate, or how I can have the document sent to him to be signed? I'm a little uneasy about sending such an important legal document in the mail.... I'm not even really sure how the signing works.. I'm not sure how the birth certificate thing works at all.. Any information or advice would be greatly appreciated, or maybe if anyone knows where I can find information or advice on this topic... This is very important to the both of us.

Try getting him to sign a Power of Attorney over to you so you can take it to the hospital with you.

My friend was in the same dilemma. She had to wait until the father got out because the certificate does require the actual signature of the person. i don't think they will let you mail it to him and bring it back because they have to be able to verify that the person's signature on the birth certificate is the actual person that signed it. They do this because when a man is taken to court for child support, his signature on the birth certificate legally binds him to have to pay. The only way he can get out of paying is if a paternity test is performed and he is proven not to be the father. Otherwise, the minute a woman chooses to sue for child support that man has to pay, sometimes without a court hearing. It should be okay for your child's father to sign it at 6 months because you probably won't be using the birth certificate yet unless you're planning on moving.

I live in Louisiana and they did not require the father to sign the birth certificate here. I seriously doubt he will have to sign it, but you can start by calling the department of vital statistics in your state, they should be able to give you that information. You could even try calling the hospital maternity ward that you plan on delivering your baby and just tell them that the father is in the army or something, you don't have to say prison, just tell them that you are worried he will not be there to sign and you need to know if it is necessary.

In most states, the father's signature is not REQUIRED. At least one parent's signature is required on the application for the birth certificate to be issued. At that time, the names of the father and mother are provided on the application, and that is what will appear on the certificate.

You sure picked well didnt you? I hope he straightens up after he gets out.Chances are he wont but maybe. You will be asked the fathers name when the birth certificate is filled out.You can take it with you when you visit him to get it signed if need be.

I'd guess that your boyfriend is in the best position to find out - or you could ask the hospital what the protocol is.

Certified mail .............it will be read ...... and censerd.........but will get to him. You can always have his name added all you do is resumitt aplication.
