How much do I have to pay in court to file? Im not getting a divorce yet but I want sole custody of my son he's 4 months old

In Maryland you can and it is suggested. In Maryland you must wait one year to get divorced and in the mean time a working custody order is a necessity. File for custody and limited divorce at the same time.

These are extremely rare cases but do happen.You will need one hell of a justifiable reason for doing so. Since you have mentioned a possible pending divorce, then go fo a legal seperation , but mom will get temporary residential custody during and unless shes ruled unfit will get permanent custody at the actual divorce hearing. It will be much easier and cheaper.Now if mom ca be rule unfit due to solid evidence of child and/or drug/mental abuse,then dad gets custody. Go for the seperation with custody first. Good luck

Custody is a matter of disposition for family court within the attendent divorce action. Without a divorce or legal separation petition, both parents have equal rights to the child if legally married.

You have to be legally separated to be granted sole custody of your son. Then you might have to go through the process again if you go through the courts to get the divorce finalized.

Custody id decided at the resolution of your separation. As long as you are married, then he has the same rights that you do.

No you cannot. For the second question your husband has to be given the right to show for the hearing. I don't know your motive behind all this but wanting to know the cost and everything you seem to be up to something dirty.
