I rent a townhouse. My neighbor moved out, and the community decided to jackhammer up their kitchen floor. All day my house has been shaking with incredibly loud noises coming through the walls. They are using jackhammer and large saw, not to mention pounding with large hammers. It sounds like I'm living in a construction site.

My community did not notify me of this work, and it has been going on for days. My children can't take their naps, and the noise is loud enough to give me and my wife sizable headaches. Does this violate my rights under a lease to quiet living, and what can I or should I do about this.

(PS, also the workers left large shards of broken glass in my front lawn where my children play. Not the lawn of the house they are working on.)

I might lodge a complaint about the noise, but I'm not sure of the legal ramifications.

The glass on your lawn is technically encroachment and is illegal. You could technically file a law suit.

Is it a new owner that is doing the remodel work? If the kitchen is next door to your kitchen maybe there is something that you should know. Be nosy and go over. Ask what is going on and find out if there was some kind of plumbing problem, settlement or leakage of some sort. The work that they are doing is legal or permitted in all Associations that I have been involved with. there are usually time limits as to when they can work. But they do not have to ask your permission or inform you of their plans. The glass in your yard is not good and you should inform your association of this at once. This is a violation of The Health and Safety laws and could actually be actionable. If one of your kids had been hurt you could sue the contractor, the association and I am sure a good lawyer would add another half dozen people to the list. Be calm, Talk to your association and say that construction debris on your property is not OK with you and that you would appreciate a later starting time in the morning. You might get some action. good luck

Construction noise is just one of those facts of life. As long as the workers do not continue with the noise during 'off hours' (about 7AM to 5PM) you are expected to live with it until completed.

You might speak to the construction foreman about the glass dangers on your lawn. He may be more cooperative than you think. OR, you could just pick up the glass shards yourself so that your kids can play safely.

Sadly you don't have much recourse........But the "golden rule" should apply, and maybe the construction crew (superintendent/foreman) is oblivious to the glass nuisance.

Approach all parties in a down-to-earth way. Rational folks like to solve problems when they can.....The construction supervisor should be no different.
