the two houses are from the same real estate but different
agents. the agent has the house for less money and the one
across the street is more money and bigger. when people
ask him about the bigger house he tells them that house is
an ego trip and the people are carrying two mortages and
need to get out. it is not his house. it is another agents house.
my agent brings me a low offer but the people looked at the
smaller house and now want mine. i have accepted the offer before i knew about this
but now im thinking that maybe thats why all offers have been
so low and is he allowed to tell my business. do you think my broker knew knew about this because she knew the agent
and is this legal? why would an agent say that when the house is not even his? what do you think if that happened to you.?

Report that mental cretin to the managing broker of his agency. Such information about a seller's financial situation is CONFIDENTIAL. He is certainly in violation of the National Association of Realtor's Code of Ethics, and may as well be in violation of his own state law regarding real estate confidentiality.

Realtors are bound by certain ethical standards and that includes not telling prospective buyers "your business". Often agents working for the same company are agents of a singular broker, thus all the agents from that office aren't allowed to tell prospective buyers "your business". But, mortgages are public record, but desperation to sell is not.
This situation is a very gray area of potential misrepresentation that should be addressed by the real estate company broker ( the agents boss) and perhaps your state real estate commission. If i were you I would feel ticked off too, and I am a Realtor!
I have no idea why another agent would even make this claim in the first place because the likely result would be that any prospective buyer would actually be redirected to your house (the bigger one) with hopes that they could get more house for a better price and no one would buy his listing. Agents don't make money unless they sell their listings. It just doesn't make sense.

It's called full disclosure. The fact that the people want out of the house across the street is material information which buyers and sellers need to know.

Mortgages are public information, but my guess is the two agents knew your story, and the one used it against you. It sounds unethical to me. Also, could your neighbors have been the one to say something to the agent?
