Reuters has reported that Asst. DA has filed a motion calling for charging the Sheriff's office with contempt.

The City Attorney in Los Angeles is challenging the Sheriff's decision to send Paris Hilton home on house arrest. The Judge has scheduled a hearing tomorrow. You can read the motion here. (pdf)
The City Attorney is also demanding that the Sheriff pick her up at her house tomorrow and transport her to court for the hearing.

The Sheriff clearly could not control his staff who were using cell phones to record Paris while behind bars. Paris did not like having her privacy invaded and the Sheriff could not ban cell phones from his staff. Therefore, the Sheriff defied the Judge's order and released Paris Hilton to home detention.
After all, Hilton made millions from her sex tape when she controlled everything from production to distribution BUT she did not like being at the mercy of the Sheriff's Deputies.
As judge, I would publicly reprimand the Sheriff and warn him that future one-sided releases would result in contempt of court and the Sheriff serving the same sentence as the accused.

The Sheriff is an officer of the court...he is not the judge.
Releasing her with the judge's permission is contempt of court, by defying the order of the judge.
The judge should return her to jail per his original sentence.

Put her back in jail, give her meds like other inmates receive if that is what she needs and let her serve her time. Martha Stewart served her time and it was ALOT longer than her. Let her stay there for 45 days! The document specifically says, no weekends, no house arrest, no ankle monitor. The judge is even upset. The judge makes the rules!!!!!!

I guess it is probably a deal between the jail and the DA if someone is released early. In this case it cannot be the jail alone that dtermines it, or the Sherriff.
