Today i got a suprising letter from a collection agency about a man i got into an accident with about 3 years ago claiming alot of money from my parents. I called to ask what was up immediately and left a a number for them to call back.

The thing is thought i wasnt liable after a certain time after the accident. i was told the cut off date was sept of 2005 for no liability for his costs unless he sues before then. hence me being able to get my license, in which i did april of 2006.


What should i do? Hes claiming money through a collection from my mother. where are my rights?

You should definently contact a lawyer. You will probally need one because collection agencies are a real pain. They will harass you constantly. I find it interesting that he hired a collection agency and did not go to court. You have no reason to pay this because there is not a judgement. So hire a lawyer and he or she will run the collection agency off. They have no legal jurisdiction, they just use scare tactics.

Go see an attorney ASAP. The statute of limitations runs only until the first attempt to collect the debt. If it has gone to a collections agency, it is very likely that they've been trying to collect on it for quite a while now. They may be within the statute of limitations. Also, let your auto-insurance company know what is going on. However, go seen an attorney.

You should hire a lawyer.

You also need to contact your insurance company about this. From what I've read, Florida has a 4 year statute of limitations.The dude has up to 4 years to sue from the date of the accident.

You have the right to ignore him and wait for a document from a court, not a collection agency.
