I'm hoping she'll be made to complete the original sentence that Judge Sauer imposed on her. It just isn't right that celebs get off with such light, or no, sentences - they shouldn't be above the law. I, also, think that the Sheriff who let her out - he is notorious for kowtowing to celebs - should be penalized for deliberately disobeying the judges' orders.

The sheriffs department in most large cities have developed ways to keep overcrowding down. So, they have invented house arrest programs and off site work release and half way houses and drug treatment programs etc. So, what happened here was the sheriffs department thought no one would notice and they did a quick shuffle from incarceration to house arrest. I have no idea how they thought they could move her to house arrest without the media noticing. Did they violate the court order? Sure, but they do it all the time for minor charges. If they kept everyone locked up the required amount of time for minor charges they would be overcrowded all the time, which carries heavy federal penalities. Remember, the Feds watch overcrowding of jails and inmates file complaints all the time with Federal district courts all the time. That is why you have prisoners all over the country, where one state pays another to keep long term inmates. So, this is something that happens all the time but it makes it look like she got early release due to her fame or fortune. In reality she would have been sent on house arrest anyway, to keep overcrowding down. Believe me, LA County has people watch the bed count all the time and deciding who to send home that is not a threat to keep the numbers looking right. All major and minor jails have to do that. It is normal everyday business. It just makes a good news story.

It appears that the judge doesn't think the sheriff had the right to release her to home confinement. There might be more to this story than meets the eye. Consider the possibilities:
a) Perhaps Paris offered the sheriff some "special favors" in return for being released to her home;
b) Maybe her psychiatrist 'diagnosed' Paris with some kind of bizarre 'medical condition' that led the sheriff to believe her life was in mortal danger if she remained in jail;
c) Maybe the judge wants a 'piece of the action' (and don't tell me that politicians, law enforcement officials, judges and even U.S. Presidents wouldn't succumb to such 'oral enticements');
d) Apparently the sheriff believed he was within his rights to release her, and perhaps he thought it was in her best interests, as well as the best interests of the community;
e) Her presence in the jail might have been terribly disruptive, perhaps to the point that it impacted on the jail's operations or the welfare of other prisoners;
f) Of course, there's always the possibility of a 'pay off';
g) Doctors might have honestly believed Ms. Hilton's life or well-being was in serious jeopardy. -RKO- 06/07/07

I think it was more an error in judgment than a "mistake." If the reporting on this is correct, the sheriff released her and the judge who sentenced her is pissed because the sheriff overstepped his authority. I think she needs to go back and serve the rest of her sentence.

No mistake. The judge was deliberate, but politics finally caught up with him, and he's scared other people will think he gave that nitwit a pass 'cuz she's rich and famous.
Imagine -- in America? A judge? Say it isn't so.

Yes, but I can understand the Sheriff's office wanting her out of their hands.
She is a logistical nightmare to take care of and protect. Remember that in the custody of the city or state, anything that happens to her can cause serious repercussions. Photos are a big issue. The paparazzi are HUNGRY and more so the tabloids for a photo of her in jail. If that occurs the state and city could be sued for breech of security and her privacy.
I don't think she should be out, but I understand why they wanted her out.

She was released after only 3 days in jail, on "medical grounds". She has been ordered to stay at home for a certain no. of days. Perhaps that's why she's in Court, to receive her orders.

I think they made a mistake letting her out. She needs to serve her time. She deserves to be punshed for what she did. Just because she's famous doesn't mean she can get out of going to jail.
