The landlord at the house she lives in now says that she had to give thirty day notice on the 1st of June, and now she cant give 30 day notice till July 1. Is that true? Why cant she give 30 day notice as of today 6-7-07 and move in 30 days from now 7-7-07? I dont understand

Yes, she needs to give 30 day notice in writing. I would suggest for her to write this letter and send it federal express to her landlord.

In the letter she could say that she will be moving out on the 1st of July. If she moves before then, who cares she already paid for her rent for that month.

What's 7 day difference? Now, she will have a very hard time with him in getting back her security deposit.

If their isn't no lease, then she should just send the letter and leave on the 1st. Their is no legal binding contract like a lease.

If their is a lease, then read the lease, if the lease says just 30 day notice, then it doesn't really matter on what date. Now, if the lease specifically says that the notice needs to be given on the 1st of the month, than she still can move, but the landlord will probably ask her for the month of July rent also or just keep the security deposit. But, he can also take her to court to try to enforce the remaining term of the lease.

He seems very unethical to me though, 30 days is 30 days.

"In addition to all of this, take a "look" at the lease, check to see what "date" she signed it. Sometimes leases are signed on the 5, 6, 7, 8, and so on. So, if her lease has a date of for example the 7th, then she is within her time frame.

Have your sister read the lease if any thoroughly.

By law there is a ten day Grace period for any payment if within that time you as well served notice to your landlord you should be fine. However I suppose it would also depend on the length of the lease. Your sister however should stop renting and start owning.

Yes that's true. my landlord did the same thing. 30 day notice on the first day of the month. She should have told her earlier

She can give her 30 day notice any day of the month she wants to. She prorates her rent if she is there only part of the month.

It is a month to month lease, as in full month ie all of June, July etc.
