Have you ever heard of this term "Law of Torts" this is with relation to compensation for any wrong committed against by any one. This law of Torts is legally recognized in India although we don't have any enactment/Act defining the wrong or its compensation etc but only follow the general principle of law of compensation. Anyone who has been wrongfully confined by any authorities can claim compensation for such wrong act & get it too by the order of the court. Many cases regarding such matters have been compensated by Indian courts. Now lets come to some enactments that do exist regarding certain compensations that the courts can order for the given offences against any person, section 357 of the Criminal Procedure Code provides for such compensation for offences such as theft, criminal misappropriation, criminal breach, cheating etc such compensations are ordered to be paid to the person who suffered due to such offences committed against him, section 358 of the Code provides compensation to the person groundlessly arrested, section 359 of the Code Order to pay costs in non-cognizable cases against whom these were committed . So at least there exists certain provision of law for compensation for wrong committed against the person. I fully agree that a separate law should be made for compensation for wrongful imprisonment defining in details the punishment for such an act as well compensation to the sufferer.

It is long overdue.
In fact a total review of laws. especially the missing accountability factor is a must. As on date even if one makes a claim for compensation, it is funded through the tax payers money (partly paid by claimant).
Wheras the responsible officers in the system have no accountability for their erroneous or at times careless or planned actions or inactions.

Why is it urgent? Has something unique happened in the last 24 hours?

Errors are sometimes made, yes. Do you believe that they should live off of everyone else from then on? Actually, no one ever forced me to think about this before, but I'm starting to wonder if it's such a good idea after all. How can you pay "back pay" to someone? That's ridiculous.

It's going to happen sometimes, it always has. But like your first answerer you just have to get on with it like everyone used to in the old days. Everyone now wants"compensation" if they fall over after drinking too much, or slip on a floor etc. It is sad but it happens. Nelson Mandela would have to ger a million!!!

If i was wrongly imprisoned i think i would be ok with it as long as my name was cleared.

Think about this for a second, say, someone stole your car. You would want them to find the person who stole it and put them in jail wouldn't you?

I know i would, and i know you would as well. Police are just like us, they are human and make mistakes. I think this is alright as long as they correct there mistakes.
