I just had my 30th B-day and live in SC. If I had sex with my 16 almost 17 year old step-son that lives in the same house as me, is this considered rape if he willingly gives it and is not coerced or forced to do said act? The age of consent in SC is 16 for boys and 14 for girls.

You are a low life scumbag and should rot in jail. You took advantage of your step-son. He is 16 and unable to understand the consequences of sex.

I don't find anything illegal about it, given what you've explained.

I also don't find anything morally wrong with it either. Even if he is your step-son, and there is some apparent violation of trust between you and your husband. I know from experience that if that marriage is not great, it's normal to seek something elsewhere.

Frankly, the whole thing is rather hot, and I wish I had a 30 year old step-mom doing me when I was 16.

I have to imagine that your step-son is not adopted by you, because then that complicates the legal matter. Please note that many people are not answering your question, and simply pushing their morals on you. Forget about them. And as for the answer a couple below me, quoting SC legislation, that legislation is indicated for cause of civil action - that is sueing someone, not a criminal violation.

Yep. You could go to prison for that. Not only is it considered statutory rape, but it would be considered incest, in a legal sense. The age of consent does not matter, because YOU are well over 18. Even if it wasn't, you're a pretty sick puppy if you want to do this. Maybe you should consider seeing a therapist.

I don't know about prison, because that is too good a place for what you have done, but you are sure on the highway to hell-o. If you have actually done this, which it sounds like you have, then you are really screwed up and need the help of a mental health professional. I feel very sorry for your husband - you have completely betrayed him by seducing his own son. And what kind of mental strain do you think you are placing on your stepson? He can never have an honest and open relationship with his father. And when his father finds out he is going to hate you and his son. You sound like someone who has walked straight out of a trailer park on to the Jerry Springer show. Get out of their lives before you mess them up worse than you already have. .

You would be guilty of the following at a minimum:

SECTION 16-15-20. Incest.

Any persons who shall have carnal intercourse with each other within the following degrees of relationship, ...

(2) A woman with her ... husband's son...

Shall be guilty of incest and shall be punished by a fine of not less than five hundred dollars or imprisonment not less than one year in the Penitentiary, or both such fine and imprisonment.

SECTION 16-15-60. Adultery or fornication.

Any man or woman who shall be guilty of the crime of adultery or fornication shall be liable to indictment and, on conviction, shall be severally punished by a fine of not less than one hundred dollars nor more than five hundred dollars or imprisonment for not less than six months nor more than one year or by both fine and imprisonment, at the discretion of the court.

SECTION 16-15-342. Criminal solicitation of a minor; defenses; penalties.

(A) A person eighteen years of age or older commits the offense of criminal solicitation of a minor if he knowingly contacts or communicates with, or attempts to contact or communicate with, a person who is under the age of eighteen, or a person reasonably believed to be under the age of eighteen, for the purpose of or with the intent of persuading, inducing, enticing, or coercing the person to engage or participate in a sexual activity ....

(E) A person who violates the provisions of this section is guilty of a felony and, upon conviction, must be fined not more than five thousand dollars or imprisoned for not more than ten years, or both.

Also, some states, not sure if it is done in SC, have a rule that if there is a 6 or 8 year difference between the two individuals, it is still statutory rape even if the younger of the two is over the age of consent.

You are his step-parent and should not violate that boundary.

You might want to consider SC authorites may try to charge you with incest.

SECTION 15-3-555. Statute of limitations for action based on sexual abuse or incest.

(A) An action to recover damages for injury to a person arising out of an act of sexual abuse or incest must be commenced within six years after the person becomes twenty-one years of age or within three years from the time of discovery by the person of the injury and the causal relationship between the injury and the sexual abuse or incest, whichever occurs later.

(B) Parental immunity is not a defense against claims based on sexual abuse or incest that occurred before, on, or after this section's effective date.

The age of consent isn't the issue here. Being a parent sleeping with your son is. That is what you go to jail for. Even in the South, that is just wrong!

Yes, because you are a person of influence over this child. Besides it being completely immoral and wrong. It could be considered incest, or at the least, like a relationship between a teacher and student. and you know where that gets teachers these days...
