I don't think so. If you and hubby bought the house together and his name is on the deed you'll have to repay him all the equity it accrued while you were married. A judge would most likely see this as selfish underhanded behavior and favor your husband during proceedings.

Sure is but only as to avoid divorce court. Make a record of all property she is to have sold to the best of your recollection and possible dates sold,and present this to the Judge and anything sold prior to 90 days of divorce court will have to be brought back in or explain what happened to it but if she cant, then reasonable value of item will be added into marital assets on her side to be split equally amongst both parties. Your part is to prove what you had and that is actually was marital property. Just an idea; you may be able to work out some kind of deal with her to prevent this from entering the courtroom, in other words to settle a compromise between yourselves outside of the courtroom and then get it on paper and witnessed and notorized so she cant come back after you. That depends entirely on when the LEGAL separation was filed and when the sale took place.
At a maximum she could be guilty of illegal conversion and a minimum of converting marital assets. Depending on the answer to the above, the agreived party needs to list all of the assets and their current value and a determination of disposal (what she did with them) then file a claim against her for the monies.
And then change the locks.
