Ok so I got caught taking pictures of the girl next door while she was laying out by the pool, and now her dad is telling me he's going to have me arrested. And I told him it was perfectly legal and to screw off, and he claims it's not legal because she's 15

so whose right?

Well, I guess you'll find out soon enough who's right. However, I think you're a scumbag for doing this. Why the hell do you want those pics? She's a CHILD, you creep!

First off, how old are you? Secondly, what do you need the pictures for? Third, would you want somebody your age taking pictures of your mother, sister, or even daughter at that age for that reason? That is just a little bit of morals/values for your conscience...I think that you could be in trouble because that is considered a form of stalking/harassment, and as long as somebody is offended by your actions, her dad in this case, the police can be called, charges pressed, you in court, and even sued. A bit of advice, try to stick to getting pictures from sources rather than getting your own, just to cover your bases!!

Why are you taking photographs of your neighbor while she's sunbathing?

Technically without written permission from the person you are photographing it is considered harassment. This will also be looked at negatively in court if you are older than the girl.

Photographers have to make and request consent before taking usable photographs of people. This avoids lawsuits.

This is dependent on the state of course, but in all honesty - if they asked to have the photographs removed/destroyed you should be respectful enough to fulfill that request.

Wouldnt that be considered "Invasion of Privacy" and if you are over the age of 18 then what the hell are you doing taking pictures of a half naked 15 year old girl? I hope her daddy does something to you, what a looser

Go out and pick a fight with a neighboring kingdom instead, David. And no, special dispensations are not available for that.

Well, actually you both could be right. Her father is right since taking pictures of his daughter can be considered spying and an invasion of privacy. But...she wasn't naked so there really isn't anything illegal about what you are doing.

P.S. Could you send me some of those pictures? lol

It's legal in my state (Illinois). There was no reasonable expectation of privacy, and she was not naked or posed in a sexually provocative manner. You're wrong for doing what you did, but you're likely within the law (I don't know the laws in all states, and I don't know what state you live in).

Well, if you're over the age of 18, then it's not legal. (Would constitute as child pornography, I believe, since she's a minor)

If you're under 18, then you're just an idiot.
